I've been away for a while, too long for me... Been dealing with a lot of stuff, had a panic attack blah blah blah. Anyway, I'm making a choice and moving back to the United States (HOME!!!). I am an American citizen born in Dallas but most of my life in the United States was spent in Florida. Now, i've been married for almost 10 years and i have 2 daughters 8 and 4 years old. Since i moved to the Philippines before my 16th birthday (6 months before my 16th b-day) my children are NOT considered American citizens because i lack physical presence in the U.S. (some stupid ruling the U.S. embassy told me here about). Well, my wife and my children do have U.S. Visa's so entry into the U.S. is not a problem. I would just like to know if anybody has any ideas on what steps i should take when i do plan to move back. My wife and kids will only be on a tourist visa and of course i want to get them citizenship. I don't want to talk to the embassy here because there's just too much red tape that i would rather not deal with. Any suggestions or help anybody could give would be greatly appreciated.
I'm sure there is a way to do it. i'm guessing that once i get there i should just apply for green cards for them. i really don't have any idea.
I think it's because they were born in a different country, I've heard about some people going to Mexico, then having their baby in Mexico, and they won't let them bring the baby to USA.
Interesting question, wish i could help you out, but i dont know much about immigration laws.... Heck, move to mexico and swim the border like all the illegals!!!!! Just kidding man! Try some government web sites that deal with this issue, perhaps even the state web sites that you are considering moving into.
I always thought that children born to American citizens were American Citizens. Its not that simple. My father was stationed in Germany ( US Army) and I was born there. The problem, I was born at home, on German Soil and not on a military base. That made me a German Citizen even though my father was American Military. Now if I had been born on the Military base I would have been an American citizen. Now is that screwed up or what? I was born in Sept 1959, I was finally issued an State Department Birth Certificate in March 1962. Ya it took that long to make me an American Citizen. I can only imagine what your going through. Its a bum wrap. my children should have been considered U.S. citizens, i lived there for 15 1/2 years and i was born there. just because i left before my 16th b-day i ran into all this trouble. Oh well, i'm sure i can get a lawyer on this as soon as i move back. It shouldn't be a problem, they'll just have to go through the green card process. I'm planning to check on the government sites to see what i can dig up. Thanks...
